There was a recent case in Canada wherein the cc issuers had to allow merchants to add the charge if they desired, without penalty. Old agreements, I believe, are now void. I don't think it is fair to make the merchant pay an additional 4%-6% to a cc company, especially with the low mark-ups in many areas these days.
